1. About Us
1.1 The website [bayanswim.com] (the “Website”) is operated by BAYAN SWIM LTD (“BAYAN”, “we”, “us”, “our”), a company registered in England and Wales.

1.5 These Terms & Conditions (“Terms”) govern your access to the Website and any purchase of products (“Products”) from us. By using the Website or placing an order, you agree to these Terms.
2. Eligibility & Your Account
2.1 You must be 18 years or older and legally capable of entering into a binding contract.
2.2 You are responsible for keeping your account details secure and for all activity under your account. Notify us immediately of any suspected unauthorised access.
3. Products & Information
3.1 We aim to describe and display Products accurately. Colours may vary slightly due to device settings and lighting.
3.2 As many BAYAN pieces are handmade, minor variations may occur; these are not considered defects.
3.3 We may update Products, prices, and availability at any time. Changes do not affect orders already accepted.
4. Ordering & Contract Formation
4.1 Adding items to your cart does not reserve them.
4.2 After checkout, you will receive an Order Confirmation email acknowledging receipt; this is not acceptance.
4.3 A binding contract is formed when we dispatch your order and send a Dispatch Confirmation.
4.4 We may refuse or cancel an order for reasons including stock unavailability, payment authorisation failure, suspected fraud, or pricing errors. If cancelled, we will refund you in full.
5. Prices, Currency, VAT & Duties
5.1 Prices are shown in GBP and include UK VAT where applicable.
5.2 For international orders, import duties, taxes and fees are not included in the price or at checkout. These are payable by you to your local customs authority or courier.
5.3 We are not responsible for delays or returns caused by non-payment of such charges.
5.4 If a pricing error is found, we will contact you to confirm the correct price or cancel the order.
6. Payment & Fraud Checks
6.1 We accept major debit/credit cards via Shopify Payments, Shop Pay, Apple Pay, Google Pay, and PayPal.
6.2 Payment is taken at checkout and is subject to validation by your payment provider.
6.3 We may carry out anti-fraud and verification checks. Orders failing these checks may be cancelled.
7. Processing Times
7.1 As our Products are handmade, please allow up to 7 business days for order processing.
7.2 Weekends and UK public holidays are not counted as processing days.
7.3 If there is a delay beyond this timeframe, we will contact you with options.
8. Delivery & Shipping
8.1 Dispatch country: United Kingdom.
8.2 Current couriers: DHL and Evri.
8.3 Shipping charges and delivery times vary based on courier and delivery option selected at checkout.
8.4 We do not deliver to PO Boxes.
8.5 Once dispatched, the risk in the Products passes to you. Title passes upon full payment and dispatch.
8.6 Delivery dates are estimates provided by the courier and not guaranteed. We are not responsible for courier or customs delays.
8.7 If a parcel is refused, uncollected, or has an incorrect/incomplete address, we may deduct actual shipping and return costs from your refund.
9. International Shipments, Customs & Duties
9.1 For orders outside the UK, you are responsible for all import duties, taxes, and clearance fees.
9.2 Customs may delay parcels pending payment or documentation. These delays are outside our control.
9.3 If an order is returned to us due to unpaid duties or refusal, we will refund the item price minus actual shipping and return/customs costs.
10. Returns & Exchanges
10.1 You may return eligible Products within 14 days of receiving them.
10.2 Returned items must be:
Unworn, unwashed, undamaged
With original tags and hygiene liner intact
Free from odour, make-up, tanning products, deodorant marks
In original packaging
10.3 To start a return, please email hello@bayanswim.com with your order number. We will provide instructions and the return address.
10.4 Return shipping is paid by the customer. We recommend a tracked service.
10.5 Refunds are made to the original payment method once the item is inspected and accepted. Please allow up to 7 business days from receipt at our returns address for processing, plus your bank’s clearing time.
10.6 Exchanges: We do not offer direct exchanges. If you require a different item, please return your original purchase for a refund and place a new order.
10.7 Final Sale: Sale items are non-refundable and non-exchangeable.
11. Rejected Returns
If a returned item does not meet the above conditions, it will be returned to you and no refund will be issued.
12. Faulty or Incorrect Items
12.1 Contact hello@bayanswim.com within 30 days of receiving your order if your item is faulty or incorrect. Include your order number and photos.
12.2 Faults caused by misuse, improper care, chlorine or sunscreen exposure, or normal wear and tear are not covered.
12.3 Verified faulty items will be repaired, replaced, or refunded in line with UK consumer law.
13. Care Instructions
13.1 Rinse swimwear after use and hand wash in cool water with mild detergent.
13.2 Lay flat to dry away from direct sunlight and heat.
13.3 Avoid rough surfaces, prolonged chlorine exposure, hot tubs, tanning oils, and sunscreens that may damage fabric and hardware.
14. Promotions & Discount Codes
14.1 Promotions are time-limited and cannot usually be combined.
14.2 Discount codes must be entered at checkout; they cannot be applied retrospectively.
15. Reviews & User Content
15.1 By submitting reviews, photos, or videos, you grant BAYAN a royalty-free licence to use such content in marketing and social media.
15.2 You confirm you own the rights to the content and it does not infringe third-party rights.
16. Website Use & IP
16.1 All content, images, and designs are owned by BAYAN or its licensors and protected by law.
16.2 You may not reproduce, copy, or use our content without written consent.
17. Liability
17.1 Nothing in these Terms limits our liability for death, personal injury caused by negligence, fraud, or your statutory rights.
17.2 We are not liable for indirect or consequential losses, including loss of profits or data.
17.3 Our liability for any claim shall not exceed the amount paid for the relevant order.
18. Force Majeure
We are not liable for delays or failures caused by events beyond our control, including strikes, courier issues, extreme weather, pandemics, or customs delays.
19. Privacy & Cookies
We process your personal data according to our Privacy Policy and Cookie Policy (see Website footer).
20. Changes to Terms
We may update these Terms at any time. The version posted at the time of your order will apply.
21. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales, with disputes subject to the exclusive jurisdiction of the courts of England and Wales.
